Clause 1: Services and Equipment Use

MixLab Music Studios, Inc. provides recording, production, rehearsal, and lesson services using professional equipment and facilities. Users are expected to use all studio spaces and equipment responsibly and follow the studio's operational guidelines at all times. Any damages caused by misuse or negligence will be charged to the client accordingly. Users assume full responsibility for any loss, damage, or injury that occurs due to their failure to follow safety protocols or equipment instructions.

Clause 2: Bookings and Payments

All bookings for studio sessions or lessons must be arranged in advance and are subject to availability. Users must ensure timely payment of fees and provide accurate information upon reservation. Cancellations or schedule changes must follow studio policy, and late adjustments may incur additional charges. MixLab Music Studios, Inc. reserves the right to cancel or reschedule bookings due to technical issues, equipment failure, or force majeure events without liability.

Clause 3: Intellectual Property Rights

All original works created by Users during their sessions remain their intellectual property unless a separate agreement states otherwise. MixLab Music Studios, Inc. will only use client content for promotional purposes with the client's written consent. Users are responsible for securing permissions for any third-party materials used during recording or production sessions. Users indemnify and hold harmless MixLab Music Studios, Inc. from any copyright infringement claims arising from materials provided by the client.

Clause 4: Content Restrictions and Liability

Users agree not to create, record, or distribute any content that is illegal, defamatory, obscene, hateful, or infringes upon the rights of third parties. MixLab Music Studios, Inc. reserves the right to refuse service or terminate sessions if content violates these restrictions. The studio assumes no liability for the content created by Users and expressly disclaims responsibility for any misuse of the facilities or materials produced. Users release MixLab Music Studios, Inc. from any claims, damages, or legal actions arising from the content they create or distribute.

Clause 5: Data Collection and Consent

By using our services, Users consent to the collection and processing of their personal information for service provision, billing, and communication purposes. Users may opt in or out of data collection at any time through their account settings or by contacting customer support. MixLab Music Studios, Inc. is not responsible for any consequences resulting from a client's decision to opt out of necessary data collection for service delivery.

Clause 6: Limitation of Liability

MixLab Music Studios, Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services. This includes, but is not limited to, loss of data, loss of profits, business interruption, or reputational damage. The studio's total liability for any claim shall not exceed the amount paid by the client for the specific service in question. Users acknowledge that they use the studio facilities at their own risk and waive any claims against MixLab Music Studios, Inc. for equipment failure, technical issues, or operational disruptions.

Clause 7: Indemnification

Users agree to indemnify, defend, and hold harmless MixLab Music Studios, Inc., its officers, employees, agents, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) client's use of the studio services; (b) client's violation of these terms; (c) client's violation of any third-party rights; (d) content created or distributed by the client.

Clause 8: Governing Law and Dispute Resolution

These terms shall be governed by and construed in accordance with the laws of the jurisdiction where MixLab Music Studios, Inc. is located. Any disputes arising from these terms or the use of services shall be resolved through binding arbitration in accordance with the rules of the relevant arbitration association. Users waive their right to a jury trial and agree to resolve disputes individually, not as part of any class or representative action.

Clause 9: Modifications and Termination

MixLab Music Studios, Inc. reserves the right to modify these terms at any time without prior notice. Continued use of services after such modifications constitutes acceptance of the updated terms. The studio may terminate or suspend client access to services at any time for any reason, including violation of these terms. Upon termination, Users remain liable for all outstanding fees and obligations incurred prior to termination.

Clause 10: Acknowledgment

By using MixLab Music Studios, Inc. services, Users acknowledge that they have read, understood, and agreed to these terms and conditions. Users confirm they are at least 18 years of age or have parental/guardian consent to enter into this agreement. These terms constitute the entire agreement between the parties regarding the use of services and supersede all prior agreements or understandings.

Privacy Policy

Clause 1: Information Collection and Use

MixLab Music Studios, Inc. collects personal information such as names, contact details, booking-related data, payment information, and communication preferences to properly provide its services. The company ensures that reasonable measures are taken to protect all information against unauthorized access, alteration, disclosure, destruction, or loss. However, Users acknowledge that no method of transmission over the internet or electronic storage is 100% secure, and the studio cannot guarantee absolute security. Users agree to notify MixLab Music Studios, Inc. immediately of any unauthorized use of their accounts or suspected security breaches.

Clause 3: Data Sharing and Disclosure

Personal information collected by the company will not be sold or shared with third parties unless required by law, necessary to complete a requested service, or to protect the rights and safety of the company or others. Information may be disclosed to service providers, payment processors, legal authorities, or business partners as necessary for service delivery. Any use of client data for marketing or promotional purposes will require the client's explicit written consent. Users may request updates, corrections, or deletion of their personal information, subject to applicable legal and operational requirements.

Clause 4: Data Retention and Deletion

MixLab Music Studios, Inc. retains personal information only for as long as necessary to fulfill the purposes for which it was collected or as required by law. Users may request deletion of their personal data through the account management system or by contacting customer support. However, the studio may retain certain information as necessary for legitimate business purposes, legal obligations, dispute resolution, or to prevent fraud. Users acknowledge that complete deletion of all data copies may not be immediately possible due to technical and legal constraints. The studio is not responsible for any consequences resulting from delayed deletion or retention of backup copies.

Clause 5: Cookies and Tracking Technologies

Users can manage cookie preferences through their browser settings or the website's cookie consent mechanism. Clause 6: International Data Transfers

By using the services, Users consent to such transfers and acknowledge that their information may be subject to access by foreign courts, law enforcement, and national security authorities. MixLab Music Studios, Inc. implements appropriate safeguards for international data transfers as required by applicable data protection laws.

Clause 7: Children's Privacy

Services are not intended for individuals under the age of 18 without parental or guardian supervision and consent. If the studio becomes aware that it has collected personal information from a child without proper consent, it will take steps to delete such information. Parents and guardians are responsible for monitoring their children's use of the services and providing appropriate guidance.

Clause 10: Liability Limitation

MixLab Music Studios, Inc. shall not be held liable for any unauthorized access, data breaches, or security incidents beyond its reasonable control. The studio's liability for any privacy-related claims shall be limited to direct damages up to the amount paid by the client for services in the preceding 12 months. Users release MixLab Music Studios, Inc. from any claims arising from the client's failure to follow security guidelines or from information the client voluntarily discloses to others. By using the services, Users assume all risks associated with the collection, storage, and processing of their personal information.
